Michigan-are there ANY governing STATE laws/acts for HOA's?

It was my understanding the HOA's fell under the old Land Sales Act of the 1970, however that was repealed last year...

Any help or direction is greatly appreciated!

Is your HOA a non-profit corporation? If so then you may be under PA 162 of 1982.

Are you detached condos or a subdivision of singlely owned homes?

What documents do you have? non profit incorp papers? Bylaws? rules and regs?

What is your question?

We are single family homes. We are incorporated and non-profit. We have by-laws. What I am trying to find out is if our soon to be formed HOA is covered under the Michigan Condominium act of 1978. Or if not are there ANY governing state documents related to single family home HOA's.Or is it strictly the bylaws? Thank you for your patience

Hi Valerie:

The above Act 162 of 1982 is potentially what you are covered under, unless possibly your documents state otherwise. In this Act are sections regarding non-profit and homeowner associations such as the following section as an example:

450.2304 Corporation organized upon membership basis; provisions of articles or bylaws; rights, preferences, and limitations of or upon members; classes of members; voting rights; condominium association; homeowners or property owners association; transferability and termination of membership; rules of qualification and government; limitations on membership.
