I think I may be in the wrong forum. I am not a board member but have a question. We do not have board members just a management company and they do whatever they want with no votes from us. I was sent to court for delinquent fees which I have paid now they are asking for more money (got divorced and was going through rough times). I received a letter from the court stating balance paid in full. I have neighbors that owed the same amount and have never been sent to an attorney and still haven't paid with no punishments. My question is, is there a law that says we all have to be treated equally? I feel like I am being discriminated agaist because I actually paid them some money,

If you have a MC with no elected Board, chances are that you are still under declarant control, meaning there is a Board you just don't see them. You don't know for a fact that your neighbors haven't been sent to an attorney only what they tell you, which may or may not be the truth.

What ever you do, do not ignore this or you may find yourself with a lien or facing foreclosure. Make a copy of the letter from the court and send it to the MC with a letter asking why they think you owe more. If they sued you all fees and fines should have been included in the suit and judgment. This may be something entirely different.

Not trying to fuss but I have seen their bills and they reflect what mine did before the attorney was involved. I received a court date and paid my HOA before our court date and received a letter from the court stating my balance was paid in full. We all have liens filed against our homesteaded homes.

Our board is the builder of our subdivision and we also do not know what to do to take control of our board they will not relinquish the positions to our community.

Somewhere in your CC&R's will be the conditions for turnover, usually it is when 75% of the lots have sold or after X number of years.
