We have a very small HOA with only 10 homes in it. We have one homeowner who put up a fence but since the back of their fence butts up with a chain link fence they didnt finish the back lot line of their fence. During the day we have gotten a few complaints that some of her dogs are getting lose and then going in and out of their 1/2 fenced area. We have already sent a letter to the home with the dogs. It may not even be that big of a deal if the dog were not Pitbulls. Almost everyone in the neighborhood has children. The only thing we know to tell homeowners that are complaining is to call animal services. Is there anything that we can do?? The lady with the dogs is a renter. Has anyone had this problem?

Since the person with the dogs is a renter, can you get in touch with the owner of the home to lay some responsibility on him about the dogs? He may not even realize his tenant has pit bulls. The liability to him would be great, I would think.

If I understand you correctly- the renter put up the fence? Does the owner even know this I wonder...also does your HOA have to approve fences first (ours does)and was it (if so how??)

Do you have something in your declaration/association documents that prohibits the dogs running free (ie. if it's a city vioation it is an HOA one as well, if something becomes an annoyance to the neighborhood it is a violation, etc.)

Ultimately, the owner of the property is responsible to the HOA for what goes on there because they are the member, not the renter (although they are subject to the rules). Most likely the owner will come down on the renter and if they have a lease, they could lose it for the problems described. Also- no owner wants to keep getting notifications from their HOA!!

Yes, Our Community has had this problem. We amended the vicious dog law. Which you can look up on the web. It states that the board can determine if the dog is vicious. Once you do this you can fine the homeowner if she dose not get rid of the dog.
