Our homeowners is faced with the prospect of allowing a level III sex offender reside within. We are unique as we live on an island in the Pacific Northwest and do not have facilities to provide for this individual. Can we amend the CCR's to not allow certain convicted felons from residing in our association? Any help would be very much appreciated.

This would be an issue you really should discuss with an attorney. Some attorneys offer a free consultation.

Just curious … What kind of facilities need to be provided for the individual?

Reside - or own? or both?

I would say there would be a big difference.

You need to ammend your Declaration, we did,we wrote the addendum and than had an attorney make any changes necessary and record the addendum with the county, after the owners voted on it.

References
The Board has to approve all leases, 30 days prior to a new tenant moving into our Condominium Complex.
We had situations very similar to yours.
