Our 40 unit condo complex has an exterior meter center that contains individual unit main breakers, which are the responsibility of the HOA. If a main breaker malfunctions which may cause damage to an interior HVAC unit, who is responsible for the repairs to the interior HVAC unit, the unit owner or the HOA?

Can you prove beyond a reasonable doubt what caused damage to HVAC unit? If so, then approach the HOA politely providing them with the information and get their response. If it is proved what exactly caused the problem, then possibly the HOA or the insurance will cover repairs.

If on the other hand the HVAC is old and just finally took a dive ... then as noted in your governing documents who is responsible will need to pay for repairs.

Without looking at your condo docs, I would "guess" it was old, and the HOA (or insurance) is responsible for the breaker and you (or insurance) are responsible for your own inside HVAC.

I would guess it would be the same situation if lightning struck and blew out the HOA electrical box and your personal laptop. Each would be responsible for their own stuff and should be insured accordingly.
