One of our board members resigned last year. At the annual meeting yesterday this former board member was nominated accepted and voted back on the board. THere is nothing I can remember reading in our documents that addresses a situation like this.

Unless your docs or state law prevent a memeber from VOLUNTEERING more than once there is no situation.

People can resign for many reasons but that usually does not prevent them from volunteering i.e. seeking BOD membership again.

There is nothing in our documents presenting this, and I don't know about the state law. When I have time, I want to get to the law library to study our stat condo laws.

I put this site in my favorites. But I can't seem to find anything addressing condominium law or HOA law. Maybe when I have more time I can study it more.

Nebraska statutes are very spread out ... go to either Property or Real Estate (can't remember what Nebraska has it under) then if I recall most of the HOA items are towards middle or bottom. Unlike other states that have everyting under one main title they have items divided out. Unfortunately makes it more difficult to research certain things.

If your incorporated, don't forget to check the corporation laws as those will also apply (but only if you are incorporated).

Bonnie - no need to search in state laws, when this is an administrative issue.

Your documents probably say that any member in good standing can run for office.

Just because a person resigns, it does not mean he/she can't turn around and be a candidate for office again at the next election time.

Susan, I wasn't planning on searchin the laws just for this issue. I feel board members need to beomce familiar sith state law.

Thank you-- I have studied it a lttle bit today. We had a problem with voting to amend the bylaws. A board member brought to our attention the percentage each unit gets in a vote. I was going to suggest ammending the master deed so that each unit gets one vote (The way previous boards allowed voting) until I readsection 76-806 of the state statues. You have been a great help! Thanks again.
