The HOA I reside in, in Florida..had Annual meeting,and due to lack of interest, only a Vote for President, and nobody else will run for office...is this legal ?

I have been reading books on condominiums written my lawyers. My understanding is if there is only one board memeber left, that member can appoint people to the board. I don't know about your documents, but according to our documents, a vote for President can not be made from the floor, only a vote for a board member. At the board meeting after the annual meeting, the board votes for a person to hold each office.

I have read that if there are not enought board members, the building may need to go into reciever ship. A good book to read is "Condo Owners Answer Book" by Bath A. Grim, Attorney at Law.

How many board members are you suppose to have?

How many board members do you actually have?

Also, are you single family homes or condominium?

If you do not have a quorum of board members then the HOA could end up in receivership and which if at all possible you the homeowners do not want to happen. If this is a potential possibility then some of the homeowners need to step up to the plate and take on the responsiblity of board positions.

As stated in FL statutes: If a receiver is appointed, the receiver shall have all of the powers of the board and shall be entitled to receive a salary and reimbursement of all costs and attorney’s fees payable from association funds.

This money will come from everyone's assessments; therefore, your fees will drastically increase to cover all these extra costs.
