There is mass confusion at my complex regarding parking and storage. The CC&Rs states my parking space is #1 and storage #1. The title states parking space #2 and storage #5. Which takes precedent, the CC&Rs or the title? Thank you for your help.

It's probably a typo somewhere. It sounds like the CC&R's make more sense by keeping the numbers together.

Was the assignment of spaces in the title based on CC&R's attached to the title or by specific language on the deed?

I don't think there is a typo. In speaking with my neighbors, their title states they have a storage room however, the parking/storage chart given at time of purchase and by the former property manager states they have no storage.

An new owner can write their title to say what ever they want. You would need to go back through the titles and compare them to the condo docs to make a decision.

Interesting situation … when you state title I assume you are referencing the Warranty Deed? It would make sense to keep the numbers together; however, the issue here could be the Warranty Deed takes precedence. This document is what was filed regarding the property and gives legal ownership to each individual owner for the described property and the spaces indicated on this document. If you sell your home the deed will state parking #2 and storage #5 as being purchased by the new owner. Therefore, I would think this document would potentially be the more legal binding reference in this situation.

That is very specific information to be in the CCRs.

Just make sure your title is accurate for re-sale purposes.

Thank you all for your help. I was told that some of the title information is wrong and we should go with information provided by the former property manager.

What is important is that you have one parking slot and one storage unit.

While the numbers may change, that does not.

Get the location in writing.
