Our builder has informed us that certain homeowners have erected enclosures in violation of the Declaration of Restrictions and must now be removed.
Does anyone feel that a Gazebo falls under the heading of an enclosure? There are no mention of them in Declaration.

It the structure was erected without ACC approval then it is a violation no matter what you want to call it. The homeowner needs to submit for approval. If they do not, then the board needs to enforce the violation via the process set up through the covenants/by-laws/design standards that were set up.

i would have to read your CC&R's (for the exact wording) before i could judge this. A gazebo may or may not be considered an enclosure, it all depends on your CC&R's.

Folks- Depending on where you live the gazebo may also be classified as a structure and require permits for construction per your local building dept.In Florida a gazebo is classified as a structure and would believe it or not engineering from a PE in order to recieve a permit....So- when in doubt call your local building dept and verify...Linda C
