Question, for years our not for profit corporation has been run by a Board of Directors, and our docs say we are run by fl st 617.
We contacted the Division of Business & Profesional Regulations,and they have no record of us as a registered HOA.
Question does that mean that we have nothing to do with fl st 720 as they continue to say or can you be an HOA without been registered?

Lots of questions, I'll start with this: Are your CCRs recorded with the county clerk?

(If you are a FL HOA you are ALSO governed by FL720)

Prior to the year 2000, all HOA not for profit corps were governed by Statutes 617. It did not matter if it was a condo, stand alone homes or co-ops, all were 617. After 2000, Statutes 720 for homes and 718 for condos were written and automatically, HOAs were then to follow one of those sets of Statutes. Many HOAs wrote simple amendments to change their Statute followings. Apparently yours did not change this.

I would hope that someone in your HOA has set of the original CC&Rs from when the developer left the association in the members care. (called turnover) In order to find out about your HOA, you will need to go to your own County's "CLERK OF CIRCUIT COURTS" records and look up the original name that the HOA was first recorded as. Apparently no one has bothered to refile the name AND perhaps has failed to file annual reports? Geez, I hope that is not the case. The records in the Clerks records will give you access to every document ever filed in the system. Because of the age of the association, you will need to go to the office and search the films.

But as to your original question, yes, you follow S.S.720 now.
