Our Hoa was started in 1981 with dues of $50.00 a year. In May of 2000, all members voted unanimously to raise the dues to $75.00.
The raise was not put in as an amendment to the By-Laws.
But we all (15 lot owners) paid the $75.00 for the upkeep of our road
Now we have a homeowner is has not paid their dues since 2003.
Can we legally bill them for 3 years at $75.00=$225.00
Or must we go by what the Bylaw said from 1981 $50.00=$150.00?

Donna, charge them $225 plus late charges and interest as applicable. Assessments should be approved each year at the annual meeting as part of the annual budget. They normally would not be in the By-laws as it would require amending the By-laws every time the assessment is changed.

and no one knew what to do!! I do belive we are way behind in Missouri (g)
