Hello, I am on a 3 person "Parking Committee" that was set up by our HOA to tackle the parking issues in our 40 home private street. The parking issue has never really been enforced beyond the President making the friendly phone call to a violator. Over the years residents has complied but recently the complaints have increased & compliance has become less so.
The committee was set up to advise the board on recommended procedures & actions that should be taken when a violation is found.
All the homes are single family homes with driveways. The CC&R's state that if a home has a 2 car garage then ONE car must be parked inside at night, if a home has a 3 car garage then TWO cars must be inside & if a home has a 4 car garage then 3 cars must be inside. Many of the homes have 3 car garages.
The CC&R's state that should a vehicle be parked in violation of the CC&R's the board shall have the right to have the vehicle towed at the owner's expense.
We have NO warning sign at the entrance (I know this is needed) or tow company contract.

The problems we are encountering currently is that homeowners are parking a boat inside the 2 car garage & have 2 cars on the driveway. Others have a 3 car garage & park 1 car inside but say their oversided Suburban & Chevy Pick up won't fit inside the garage.

I am personally against towing, can the board enact a warning & then fine without the need for a full member vote?

Please advise, any assistance will be most appreciated.

YOU CAN NOT TOW A VEHICLE PARKED IN A PRIVATE DRIVEWAY ... PERIOD.

Unless you get a court order.

If the vehicle is parked in the street .. ticket it .. 'boot it' after 36 hour non-compliance .. BUT YOU ALL MUST FIRST "POST" COMMUNITY SIGNAGE !
