Can someone in Maryland send me copies of your Homeowners (not Condo) Association Bylaws, please. Also can anyone in Maryland discuss how you incorporated the Maryland Homeowners Association Act into your bylaws.

It souunds to me like you are pretty much not informed on how HOAs are structured.

Your association should be incorporated as a non profit organization by Articles of Inc or perhaps a Charter. This document will say that you are (Name) HOA and operate under the Maryland Homeowners Association Act. It will say about governing under a Board of Directors, how to have elections and to be guided under the Bylaws of the named association.

Are you an exhisting association or just brand new and recently turned over by the developer? Along with your Incorporation, you should have an exhisting set of restrictive covenants and a set of bylaws which the developer had originally set up the developement with. Do you have any of those?

There is no need to incorporate the Maryland Homeowners Act in your bylaws. Just referencing the Act is good enough. And understand that there is no need to update your bylaws because of recent changes to the Act. State law automatically takes precedent over your bylaws.
