I live in a community that has a Master Association and 12 sub associations. Ten of the sub associations
are Condo associations and two are Home owner associations.

My question is should the Master association be set up as a Condo association or should it be an HOA

IMHO - it should be incorporated, for sure.

What did the Developer set up the Master Association as? There should be the Articles of Inc for the Master. What does it say the Master is filed as? If no one can answer that, then you can find the Master Incorporation papers on the State's data base for not for profit corps. This is nothing that anyone can have a vote on. The papers must have been filed prior to construction of the Master.

Each sub association I presume has it's own set of documents as well?

I had to dig deep to find this but it is written in a Becker/Polikoff article from their archives. Judging from this article, I would say that your Master is governed by Fl S.S. 720

"Typically, if
a master association is composed only of
condominium unit owners, then it will be
considered a condominium association and it must
comply with the Condominium Act. However, if
the master association includes non-condominium
unit owners, the association could be a
“homeowners association” governed by the
provisions of Chapter 720, Florida Statutes. For
example, if you live in a large community which
includes a neighborhood of single family homes, a
townhouse community, and a condominium, the
master association would not be considered a
“condominium association”."
