I have just been appointed, as of yesterday, the Chair of our HOA's Fining Committee.

We have never had a fining committee before, and as of right now I am not sure what the BOD is wanting me to do. Together, the BOD and I are working on the details as to how we are going to operate.

Does your HOA use a fining committee? How does your fining committee work?

All advice is welcome.

As chair of your committee, I would suggest that you know BEFORE you start, exactly what is expected of the committee. Is there a job description outlined? What is the intention and purpose of a "fining" committee?

Is this permitted in your CC&R'S? Is there a fine schedule? Does this committee fine HOA members for late assessments, fine them for CCR violations or both?

If you are talking about CCR's and "rules enforcement" or "rules compliance", the purpose is a little more clear and appropriate responses could then be made from those of us on this type of committee.

The objective of our HOA rules enforcement committee is to gain compliance and corrections. We refer to it as the rules compliance committee. Monetary consequences (fine$) help deter the need to go to this extreme when all we (HOA & committee) truly want is compliance.

The BOD retains full authority and decision making responsibility to issue fines based on the committee's recommendations. Fines are issued as a last resort when all other reasonable measures have been taken to gain compliance.
