We have a voluntary HOA for our subdivision of 109 homes. About 90 of the 109 homeowners belong and pay an annual dues of $40. The money is used to pay for the maintenance of our front entrance. We had some unexpected expenses with lighting and we will be a little short of funds because of it. We would like to sell some advertising on our web site to make up the shortfall. Are there any IRS consequencies for doing this? We are not incorporated and do not have any official legal structure at all. The association membership is strictly voluntary and no one on the board is compensated in any way.

Similar question as in your last post. Therefore, same answer applies:

A HOA is not required to incorporate.

Associations MUST file taxes on income. If you decide to sell advertising, the revenue from the advertising is considered revenue.

Incorporated or not, if you have income you must file taxes. Even the booster clubs at schools have to file tax returns. Therefore, you should have already gotten a tax identification number. If not, get one now and use it to make sure your bank account is filed in organizations name and under that id number.

Yes, you can sell ads to pay for your web site. Collect as many ads as you need to pay for costs.

I'm not being a jerk, but HOA web sites rarely get any traffic. How many home owners, out of 90, visit your web site? Maybe 8? Who would pay you to advertise to 8 people? Just saying........

My Association has had 4 or 5 companies write and ask about advertising on our site. You are correct, there is not a lot of people that take advantage of it. Maybe even less than 8 and that would be counting the Board members who use it from time to time.

I've had requests from a credit union, a couple of contracting companies and some Realtors.

Our Board has opted not to sell advertising because we didn't want it to appear that the Association was endorsing any one company. Therefore, I can not tell you how much money would have been made (discussions never got that far). However, there are several Associations around me that do sell advertising and they have more than enough people willing to pay something so expenses are easily covered.

Until we were approached, I thought as you did, who would want to spend money to advertise on our site or in our newsletter.

You have to think positive and give them a reason to go there. I have two advertisers that have paid $99 each for one year on our web site. One is an attorney. Plus many others that have expressed interest. For seasonal businesses such as lawn care, pool and sprinkler service, tree service, etc. I will offer six months for $49. I've put everything on hold because I don't know anything about IRS reporting requirements and afraid of getting in over my head. Our web site gets lots of traffic because we post our newsletter there plus announcements, covenants, bylaws, photos and links to the advertisers web sites and a link to our facebook page where our advertisers get "likes" and a "favorites" postings. From there their business names go around the facebook page world. In January alone we had over 500 hits to our web site.
