Interesting Florida Statute

When looking at some Florida statutes for questions posted, I ran across this statute:

(10)RECORDING.—Any parcel owner may tape record or videotape meetings of the board of directors and meetings of the members. The board of directors of the association may adopt reasonable rules governing the taping of meetings of the board and the membership.

Hmmm ... this could be a method to insure everything is done proper and eliminate potential he said/she said scenarios. This would also be a good method to insure election results are proper. Interesting ...

Our P.M. also tapes the meetings for accuracy of the meeting minutes. Once approved, then the recording is deleted.

One HOA that I was involved in had a H.O who taped the meetings. His restriction was the location of his camera could not be further ahead than any sitting members positions. ( I would have asked him to get my best side

)

He actually did this to post on our web site whenever there was a discussion that directly affected the members, like Budget discussions, and topics that all members should be aware of. Seems like overkill to me but he had the right to do it.

Just remember that you should inform the Board and members at the meeting that the meeting is being recorded prior to the start of the meeting.

I did forget to add that. Each meeting , the members are informed that the meeting is being taped.

Some in our community want to do a "broadcast" over the internet using skpye or another "go to meeting." That way folks who are unable to attend because of children or disabilties can still be part of it. We would have a way to "instant messege" the one in charge so that questions could be asked and so on.

Our current BOD is sooooo against this, and disconnected the wifi in our clubhouse.

My neighbor wanted to use his wireless connection, but the BOD just said they will speak so low no one can hear them.

Elections are coming up next month, I will keep you posted. I believe that only BOD members that have something to hide or don't want people to participate do such things.

Colorado does not appear to have a similar statute, but I think this is a very good statute that maybe other states should possibly consider.

Donna … thanks for the input … it might by overkill, but if you think about it for board members it is also a good CYA!

Tim & Donna … I totally agree that everyone should know that the meeting is being recorded, to do otherwise would be very immoral and unethical.

Heather … you do not need wifi to tape or video a meeting and which could be later broadcast to members who could not attend. You are right with regards to there are some who do things underhanded and would not like this option. But if meetings are recorded, then it helps eliminate underhanded or unethical actions taken.

This is a very interesting debate issue.

I agree with your Board on this one. Allowing a Skype or broadcast will affect attendance at the meetings or if that is what the members are going after, then the meetings will have less attendees.

Donna ... I might have to agree on that as sometimes things get too technical to the point there is no longer interaction between individuals. I for one get very irritated when I call a number and 5-10 minutes later after pressing different keys finally get to the department I wanted to speak with ... it is sad that we have become so technical that there is no longer actual "customer service" and physically speaking with a person instead of a computer?

I kind of miss those old days ...
