Our Docs state that a homeowner must submit a request in writing to review association documents. Florida 720 changed on 07/01/2010 I believe and according to what I'm told homeowners now need to submit a request in writing via CERTIFIED MAIL RETURN RECEIPT REQUESTED. (1) is this true?; (2) does it apply to all Florida HOAs under 720 and supercede our Docs; (3) where can I find the specific wording or the new law? Thank you.

Steve you can just Google "Florida Statutes 720" to get a link to the State statutes. I reviewed 720.303(5) and it doesn't say anything about the request being certified, HOWEVER that is one way to prove the HOA got the request.

(5) INSPECTION AND COPYING OF RECORDS.--The official records shall be maintained within the state and must be open to inspection and available for photocopying by members or their authorized agents at reasonable times and places within 10 business days after receipt of a written request for access. This subsection may be complied with by having a copy of the official records available for inspection or copying in the community.

(a) The failure of an association to provide access to the records within 10 business days after receipt of a written request creates a rebuttable presumption that the association willfully failed to comply with this subsection.

(b) A member who is denied access to official records is entitled to the actual damages or minimum damages for the association's willful failure to comply with this subsection. The minimum damages are to be $50 per calendar day up to 10 days, the calculation to begin on the 11th business day after receipt of the written request.

(c) The association may adopt reasonable written rules governing the frequency, time, location, notice, and manner of inspections, and may impose fees to cover the costs of providing copies of the official records, including, without limitation, the costs of copying. The association shall maintain an adequate number of copies of the recorded governing documents, to ensure their availability to members and prospective members, and may charge only its actual costs for reproducing and furnishing these documents to those persons who are entitled to receive them.

Glen - I'm not sure you have the 2010 statute. For example, the 2010 720.303 (5) (3) reads

The failure of an association to provide access to the records within 10 business days after receipt of a written request submitted by certified mail, return receipt requested, creates a rebuttable presumption that the association willfully failed to comply with this subsection.

Carol, I stand corrected; I was on the official State site, however it wasn't displaying 2010 but the 2000 statutes, go figure. I don't believe the requests have to be by certified mail however a person can't claim the remedies under section B without it. Here is the corrected section:

2. Information obtained by an association in connection with the approval of the lease, sale, or other transfer of a parcel.

3. Personnel records of the association’s employees, including, but not limited to, disciplinary, payroll, health, and insurance records.

4. Medical records of parcel owners or community residents.

5. Social security numbers, driver’s license numbers, credit card numbers, electronic mailing addresses, telephone numbers, emergency contact information, any addresses for a parcel owner other than as provided for association notice requirements, and other personal identifying information of any person, excluding the person’s name, parcel designation, mailing address, and property address.

6. Any electronic security measure that is used by the association to safeguard data, including passwords.

7. The software and operating system used by the association which allows the manipulation of data, even if the owner owns a copy of the same software used by the association. The data is part of the official records of the association.

(d) The association or its authorized agent is not required to provide a prospective purchaser or lienholder with information about the residential subdivision or the association other than information or documents required by this chapter to be made available or disclosed. The association or its authorized agent may charge a reasonable fee to the prospective purchaser or lienholder or the current parcel owner or member for providing good faith responses to requests for information by or on behalf of a prospective purchaser or lienholder, other than that required by law, if the fee does not exceed $150 plus the reasonable cost of photocopying and any attorney’s fees incurred by the association in connection with the response.

The State still has not posted the 2010 Statutes. Why? Who knows but Carol is correct. The request must now be by certified mail.

Donna we are just going to have to disagree on this one. The statute doesn't say the request must be certified. It says if the HOA doesn't provide the documents after receiving a request by certified mail that the HOA is deemed to have willfully violated the law and is subject to the penalties involved.

Now if you go back to my first post, I agreed that it was a good idea to send it certified however it is not IMO a requirement.

The law "cuts both ways".

A request DOES NOT have to be via USPS CM...

...and the HOA DOES NOT have to respond to any other form of request.

If the inspection request is fact-finding in hopes to settle some type of member dispute it is in both parties interest to establish the request:inspection timeline.

Only USPS CM meets Fla. Statute requirements.
