I am now a Board member trying to fix a very large problem in our Leawood Lakes Community in Naples FL Collier County.We had two developers 1st sold out and second completed project. When our development was being planned in 1993 by the 1st developer who was in corporated 1989, he rezoned to a Planned unit development ord.095-77 and got his written 1995 plat with dedications to HOA and county and 1995 plat maps of all common areas private roads and all 207 subdived residential lots. 1st developer built 11- homes in 1996 then got into financial trouble and sold the remainder of thev community to a holding company who the sold to the second developer who restated articles of Corp for the HOA and recorded a Declaration in 2002 with the county but TOLD the community's new community board that there was 11- non members but the declaration doesn't say there are nonmembers 207 total residents, nowhere in writing does it state 11-non members by FL. Statue 617 manadatory membership parcel ownership.
2010-2011 OK so the current day, attorneys firm was presented this problem He got his dates mixed up with the PUD and said they were not members because the homes were sold prior to being rezoned but they werent Plat PUD 1995, 11-Houses built and sold to residents 1996.Then the HOA attorney's firm said there wasn't a 1993-1995 Declaration recorded prior to the 2002 Declaration before these homes were 11-built so where our private roads so we don't really own the roads either the 11- non members do?. How does he know this? Our 2002 Declaration looks like the original only amended and even makes reference to the old repealed PUD ordinance 1994. Surely the 2nd developer had followed the 1995 PUD oridanace for development. The attorneys firm will not address this issue even though I have tried to show him his dates are wrong, so I contacted the DBPR who sent the management compnay a "Letter Of Guidance" on this matter but no one at the management company seems to be able to find this letter I double Checked with Tallahassee General Council they had sent out the letter.
These 11- alleged non-members for example of 1 of them will not repair paint or maintain house or put away all there junk piled up on front lawn and driveway decorations from 2009 halloween and christmas still up
