We finally have a special meeting set up to count ballots for the removal of 4 out of 5 of the board of directors.(the 5th was appointed recently)
We, a group of H/Os, collected 116names on petitions and ballots from both local and out of state homeowners. My question is: the property mgmt comapny set up this Special meeting with the BOD and mailed out new ballots to the entire community. Does this mean our ballots and petitions which were signed over the past 3 mos to remove the BOD will not count at all? Can they be included minus any duplicates to count toward the quorum? I am afraid we will not have a quorum (51%) otherwise.

What was the purpose of the petition?

Usually it is a request to Notice the call for the meeting, not vote on the motion.

From what I know your petition was to vote on the removal of the members of your Board.

The MC and Board have now set up a meeting as you requested to vote on that issue. THEY NOT YOU run that meeting. THEY NOT YOU supply the ballots, collect them and determine the results.

From what I know you do not get to bring you ballots, or signatures, or documents which you have collected over the last three months and use them in ths vote.

You requested a vote on your petition to remove the Board that vote should be held under the control of the Board and MC with ballots and or proxies supplied by those same parties.

Again, the documents should make this clear and you need a clear understanding of the procedure in order to give yourself some chance to prevail.

IMO any prior documents or ballots you may have collected would not be part of this meeting.

Thank you - yes we had petitioned to remove the board, but those petitions have never been looked at by the board or the mgmt company.They refused. Then, we secured over 10% on a separate petition to get a special meeting and now we got it. Hopefully this will end one way or the other.
Our board has had secret meetings, removed the president and then brought him back 3 weeks later as member at large - no explanation. They hired a board memeber to do our landscaping and pay him in secret. The monthly minutes are read in silence to themselves and then they approve them. They refuse to discuss the pool issue - which is moot at this point since it is no longer ours to share. Over 15% of the h/o are in arrears with no liens filed against them since we hired this mgmt co 2 yrs ago!

You should contact the members you collected ballots from and explain to them that those ballots will not count and they will need to complete the ballots mailed by the Board.

If your Association allows voting by proxy, you could also request that they designate you or your committee as the proxy.

THIS IS ALL IN THE BOARD'S POWER. MOST LIKELY DONE IN EXECUTIVE SESSION.

ALL CONTRACTS ARE AVAILABLE TO MEMBERS, ASK TO SEE IT. YOU CAN ALSO SEE THE BUDGET LINE ITEM AND TRACK THE COST. THERE IS NO WAY PAYMENTS CAN BE MADE "IN SECRET"

NOT UNUSUAL, MANY BOARDS PASS MINUTES WITH THE EXPLANATION, "IF THERE ARE NO CORRECTIONS, THE MINUTES ARE PASSED AS READ." THE BOARD PROBABLY GOT THE MINUTES AHEAD OF TIME. UNLESS YOUR BYLAWS SAY SO, MINUTES DO NOT NEED TO BE READ OUT LOUD. AS A MEMBER, YOU CAN REQUEST COPIES OF THE MINUTES.
