A convicted felon serving on a HOA Board.......I know the FS and our HOA docs has nothing saying they cant serve on the board but does insurance carriers have anything agaianst it?

What kind of convicted felon? There are hundreds of thousands of ex felons that have paid their debts to society. Many did stupid things when they were young so that means that forever in their lives, they cannot try to live a normal life in society? Just hope that he is not a mass murderer and goes "postal" on you. There is no law that says that he cannot try to be part of your association. If he can afford to live in your community, he must be doing something right.

As I read most of the laws of the US today, I would say that
1) Donna is right, it's probably legal
2) Everyone serving on a board is probably an unconvicted felon. The only difference between this person and everyone else in America is that this guy got caught and convicted. We haven't yet for all our crimes.

The 718 FL Condo statute says, "A person who has been convicted of any felony in this state or in a United States District or Territorial Court, or who has been convicted of any offense in another jurisdiction that would be considered a felony if committed in this state, is not eligible for board membership unless such felon’s civil rights have been restored for at least 5 years as of the date on which such person seeks election to the board. The validity of an action by the board is not affected if it is later determined that a member of the board is ineligible for board membership due to having been convicted of a felony.
I don't see anything in FL 720 for HOA's with regard to this issue.

Thanks Carol, that is good information. This HOA is a 720 community and NO, there is nothing in those Statutes prohibiting a convicted felon from serving on a board.
