I am just curious what will happen here? I was on our board until this spring. This unit has been skating and manipulating attempting to dodge foreclosure for over a year. We are owed thousands in back dues..ane here comes in RENTER #3 for the year of 2010.

The renters moved and caused massive damage to lights, holes in the stairwell drywall and made our fire door look like it's been hit with a sledge hammer. They were seen via cctv forcing a large object up 3 flights of stairs, they can't deny the damage. Our HOA has confirmed this was done by the renters moving in. The Renters admit it...

The damages total $1500. ( I hope what ever junk they were moving in was well worth it!

My question... doesn't our board have to go through the dead beat homeowner who keeps renting his unit? Or can we go directly to the source? Our board is handling this for sure, but curious what their options are.

This is a tricky one and could be approached either way.

As a legal entity, the corporation can seek reimbursement of damages from the renters. If that fails, or if they chose not too, they can seek reimbursement of damages from the member since they agreed to be responsible for their guests/tenants actions as typically is outlined in your governing documents. Another option could also include turning it into the Associations insurance company and let them decide who to go after.

If it were my Association, and unless your insurance deductible was very low I would recommend seeking reimbursement from the tenants first. If that fails, then I would approach the member indicating that you had tried to directly contacting the tenants but with limited success.

I also live in Ca. and may have a answer for you. I know that Ca. has a law that allows HOAs to file a claim forcing the Renter to pay rent to the HOA to collect back dues and fines.

You may want to search the term "Assignments of Rents".
