It depends on the specific wording in your governing documents. In many cases, yes. In these situations, each spouse would have a vote in matters before the board (those items voted on in regular board meetings), but only one household vote in matters before the association (elections, bylaw amendments, etc.).

We discussed it in our HOA and shot it down pretty quick. Even if the CC&Rs/Bylaws doesn't specifically prohibit it, we agreed that it didn't pass the sniff test to allow one property to hold two board positions.

May be perfectly okay based on your wording, but we determined that it wasn't the ethical thing to do.

If the couple had two properties in the HOA then I'd say no problem.

Also, I wouldn't suggest this if you want a happy marriage!

You should now present those arguments to the membership and amend the bylaws to prevent it happening in the future. Something like:

Only one member/individual from the same lot may not be elected or appointed to the Board of Directors.

It does have to be according to your cc&rs. If they own several homes or units it could be a possibility. Being married myself, I'd say that often my spouse and I don't agree on things in our community ( he has one opinion and I have another ). It may not be such a dictatorship with spouses serving together. I am just glad to see anyone involved.
