Can you please clarify if a ballot still needs to be mailed out for an election of an HOA in Florida? The reason I ask is if you can write in from the floor why waste the money on postage and mailing fees. We mailed out the notice of election along with the candidate form 40 days before our election. Any help would be appreciated I am new to all of this....

Usually with a 40 day time period for the ballots to be mailed in, the ballot should list all the candidates.

Were the nominations closed at that time?

IF write-ins and nominations from the floor are accepted at the meeting, those people who mailed in ballots missed out on the option of voting for late candidates.

We have some Florida "experts" here. They will chime in.

The reason is that THE STATUTES REQUIRE IT. Nominations from the floor are probably not common in your association so you may not have to deal with them but you are required to follow the Statutes for elections.

Actually mailed ballots are only required, generally, for Sec 718 entities (condo associations), they're not strictly required for Sec 720 entities (HOAs).
