The chair of our landscape committee makes frequent recommendations to the board which are often controversial. Her husband is running for a board directr's seat and will guarantee one vote for her schemes. Is this a conflict? We prohibit 2 directors from the same unit. Is there anything in the codes to prevent this or at least fully disclose the potential conflict?

Technically it's not a conflict of interest. However, the Board could ask the spouse to abstain from any vote dealing with the landscape committee to avoid any appearance of conflict of interest.

I'm glad to hear that you have a rule in place preventing two people from the same lot serving on the Board. I wish our Association had the same rule - but we would need to amend our Articles of Incorporation for that and membership apathy prevents the required number of votes being received.

Unfortunately, depending on the apathy within your membership, Associations can find that there are only x number of volunteers for y number of positions. This can sometimes lead to appearances of conflict of interest as the Board fills the positions with whomever steps forward.

Oh geez.

There is NO conflict of interest, unless the husband could benefit in a $$$ way.

This situation is no different than if the board member and chair were best friends.

Move on to another more important issue.
