The exit door to our condo building broke as my Son was entering building. The "door closer" arm came out of the drywall/wood.

The arm needs to be reattached & secured. I approached the HOA president to let her know this happened & now have been given a bill for the repairs. ($125.00)

I am under the impression that this repair should be covered under the HOA insurence as a common area repair. Granted my Son was the unfortunate person that entered when the door broke, but it was not due to negligence on his part...basically bad timing.

It appears that your Board believes that there may have been some negligence on your son's part. You should approach the board to request a meeting about the fee and have your son explain what happened.

If the Board still decides to lay the entire blame on your son, your only choices would be to:

a) Pay the bill
b) fight the issue in court.

Do not simply chose to not pay the bill/assessment as this will only open up huge issues for you.
