We have solicited all HOA members in our subdivision to get an indication if 75% of owners would be in favor or not in favor of a possible zoning change in which a new church is to be built. We have received 30% response. Would the non responders be considered a yes or no vote or not at all?

If you didn't vote in the last Presidential election should your lack of a vote have been cast in favor of Obama or McCain?

Just as a non-vote doesn't count in support or in opposition of any issue, a non-reply would only indicate a condition of apathy. It does not count in favor or against any issue.

Why is the membership being asked to OK a zoning application? Isn't this the municicaplity's job?
Do you own the property?

If more objectd, you would have heard from them, believe me.

Loretta, for starters expecting a 75% response is not realistic. I suggest the Board count the number of votes in favor and those opposed and act in accordance with the wishes of the majority of those who responded.
