We are in orlando and have a few owners in our gated community that we know do not have a valid license but are driving.

Can the Association not allow the person into the community (or not let them drive onto the community) or are we required to them them in?

Do your CCRs say that the BOD is resp. for checking for driver's licenses? I believe that's why we have police depts! I think it would be wise to just stick to managing the assn in accordance with your gov. docs. BTW, how do you know whether or not a person has a valid driver's license?

Stick to enforcing your CCRs & other HOA docs.

That is the LIMIT of your authority.

If you believe that they do not have drivers licenses and are driving, you should contact the police, provide them with the tag number of the vehicle, the typical time of day that the vehicle is on the road and ask that they investigate.

The police will know if they are legally able to stop the vehicle to check.

are your roads public or private? If private, no state issued license is needed to drive, unless you have rules that state it is.

If public, then tell the police, unless your CC&R's contain a rule about it, and give your HOA the legal right to enforce this as a rule.
