No mention of common elements at all, so again, my question is would the above apply, replacing soil with mulch, rocks of bricks.

IMO yes. The common elements even those directly outside your unit belong to everyone, not you and the COA or Co-Op whatever you are is responsible for landscaping. If you want to do something like this you need to go to the Board and get permission, in writing, to do it; not do it and then try to get permission.

The question you are asking has nothing to do with the covenant you posted which only applies to the building. Changing the landscaping is not allowed, as you do not own that area, as Glen pointed out.

FYI, my architectural guidelines read as follows under architectural control: "No building improvements,alterations, repairs, rebuilding,excavation, grading, landscaping or other work which in any way temporarily or permanently changes the visible appearance of any of the property or any improvements locaetd therefrom, from its natural or improved state existing on the date such portion of the property was first subjected to this declaration, shall be commenced, made or maintained without the prior written approval of the architectural committee."

I live in a planned community of single family homes. As you can see I cannot make any changes to anything on my property w/o the approval of the A/C.
