Our Board established an ad hoc committee to look into our recycling issues. The committee reported back at last Board meeting with their results and proposed that Board place the item on the ballot at our Annual Meeting for residents to vote on. If the Board denies their request can a petition by residents force this? Our documents address petitioning by residents but not to add items for vote. Thank you.

If you are a HOA, Florida Statute 720 (720.303(2)3(d)) says that you may petition the Board to place an item on the agenda. Other than addressing the petitioned item at the meeting, the board is not obligated to take any other action requested by the petition.

There is no provision to force the Board to vote on an item.

You would need to check 718 if you are in a condo.

What is the "item" - will it involve additional costs?

The Committee is charged with making recommendatins to the board, but the board does not have to accept them for action. The board is supposed to check the feasabiity, cost and compliance for any motion and can deny putting in front of the Membership for these reasons.

As stated before, you will have to go thru the back door to get the general Membership approval for whatever you want to do.

It would help if we knew just what the Committee recommended to be put for a vote.

What type of item are they wanting to go to the members for a vote? Some Counties will offer recycling programs that may not even require a vote from the members. What County are you in?

We currently recycle aluminum cans through our Men's Club and newspaper through the Social Committee. We do no other recycling in the community. The ad hoc committee was looking for a way to have our trash company add recycling to our pick up with no cost increase to the residents. This would include items such as glass, plastic, tin cans, cardboard, etc. The organizations above fear that introducing this will reduce their take which they use to support activities in the community. They requested the Board add an item to the March ballot to have residents vote on whether they want to recycle or not. The drawback is we lose 1 trash pick-up day. Tuesday would be trash pick-up, Wednesday is yard waste and Friday would be recycle vice 2nd trash day. To add to the mix, their is a Geo-Plasma plant being built in the County which when in operation (2013) will "nuke" all trash doing away with our landfill. This plant will destroy everything so recycling become mute at that point. Hope this answers your questions. Thanks.
