I live in a 16 unit condominium complex. Under the "Expenditures, Maintenance Fund Section of our CC&R's, they state that maintenance costs incurred for the benefit of a particular Unit or Units shall be specially assessed to the Owners of such Unit or Units.

Does this actually mean that each owner should be assessed for a repair to their roof for instance, unless all the roofs are repaired/replaced at one time?

It means that if a particular unit requires maint, outside of regularly scheduled maint for all units, then the unit owner shall be assessed the cost of that maint. IMO, the article is somewhat ambiguous and may lead to abuse by the BOD in that they could get away with requiring unit owners to pay for all maint on units.

One building has 8 attached units, another building has 5 and then there are 3 seperate, free standing units for a total of 16.

The issue is that our board has spent thousands of dollars over the years repairing individual roofs and replacing wood trim, door frames, etc., on the building that they live in while neglecting the rest of the complex. And I was wondering how the statement in our CC&R's applied to this.

It's in the section titled "5. Expenditures, Maintenance Fund"

"The board shall collect the maintenance fund hereinafter provided for and shall contract, make expenditures, acquisitions and payments therefrom for the following:"

Then skip to section "5.6 To provide for painting, maintenance, repair and all landscaping of the common areas as the Board shall determine are necessary and proper.." (except for the interior surfaces where) "..all such maintenance shall be at the sole expense of said owners."

Then it lists 5.7 taxes, 5.8 insurance, 5.9 enforcing the CC&R's, 5.10 trash collection, etc.

At the very end of section 5 but not numbered the statement reads "In the event that any of the foregoing costs of expense are incurred for the benefit of a particular Unit or Units, then the cost thereof shall be specially assessed to the Owners of such Unit or units."

I can't imagine charging each owner every time a repair is done but also can't imagine what else it could possibly mean. It would definitely be in my favor but seems like a rather unreasonable expectation.

Forgot to say that my condominium is one of the three detached units. We all pay the same dues.
