A question arose at our Annual Meeting. Who is responsible for the weeding/seeding and watering of common areas? and would the front lawn of our property be considered a common area? Our PM says the residents need to maintain the front lawns (except for cutting). At closing we all received binders with warranties, etc. in the binder was a sheet of paper with "recommended lawncare" from the builder. One of the board members said he thinks we signed a paper at closing stating we would maintain our front and back lawns (weeding/feeding/watering). Noone can produce this paper and I don't believe we did sign such a paper.

The residents at the meeting feel that since we live in a townhouse/condo the association should pay for the upkeep all common areas including weeding/feeding/watering. (we do not have underground sprinklers).

Any help on this question would be appreciated.

It will depend on your governing documents. I live in a townhome development and the Association does not maintain the front, rear or side yards of any lot. That is the sole responsibility of the owner of that property.

I would think that whoever owns the property would be resp. for maintaining it. Thoroughly review your CCRs to see what is stated in there about maintaining common areas. If the area is definitely a common area I would think it would be the resp of the assn. to maintain. I would be surprised you signed any paper at closing regarding this.

Sorry, I prematurely hit "send"!

The only time there would be an an exception might be if the area you are referring to is an easement area. In many instances easement areas that border private property are the resp. of the prop. owner to maintain. You need to know exactly what type of property this is -- an easement area, a common area or your private property.
