We have an issue in our HOA where one of our 7 additions wants to secede from the Association. Private roads are involved which are owned equally by all members of the association. Additionally, we have 400' of waterfront, a pier and dock, boat ramp and two community buildings that each homeowner owns in equal shares. This group of 28 out of 138 want to leave the association because the dues were raised from $300 to $370 per year. They feel that the current Board is too strong. The fact is that the Board is managing IAW the by-laws.

If there is no provision for seceding from the assn in your CCRs then this is not something that can be done. Membership in an HOA is for the whole time that you own the property that is located within the HOA. Tell this group that the only way they can "secede" from the HOA is to sell their property!

John - 20% of your membership want out just because of a $70 raise in assessments? There must be more to the story.

What else is going on here that these people have formed a group and want out?
