Can a manager place a members name for election to the Board without the members permission, as he had no idea he had been placed on the Ballot untill it came time to vote, this was in order to keep another member from being elected. He placed another member, who lives out of state, by asking him to be on the Ballot. Thanks for your replys

Simply answer--NO! It sounds like your Manager is fearing the worst, that there will be no candidates on the ballot OR he does not like or want those who are on the ballot to get elected. What is going on?

I first have to ask, where was the board when this was being done? This manager seems to have more authority than a manager should! The board should have rules in place, one being that no one's name shall be placed on the ballot unless they have agreed to it. This may not be outlined in your bylaws but it should be something that is automatically done. I call it having a little common sense. Of course we all know common sense is not so common!

Thanks Donna, all this came from my requests all year for certain Documents,only to recieve 2 of these ,one being Landscaping, where it took 4 months and another being a request for a copy of his contact, in October, as he had informed me that he was in "complete Control." He also would not allow me to vote the 10-12 "proxies" from our members, due to a cross over of "special" to "Annual," as I had no more copies of the annual written proxies, at the moment. He would not allow me to have those dropped proxies as he said he had to place those in is file.

So there was a "special members meeting and it got changed to an annual meeting? You need to fill in a few of these lines for us.

Do your documents allow for Proxy voting. what kind of proxies and why did he get them? Did you give them to him?

But for the record, he is NOT in complete control, the Board is supposed to be. If indeed the Board is allowing him complete control, then get rid of those Board members who allow this from him. Who is taking care of association funds? Someone better know what he is up to.

Your original question was confusing.

Are you saying that the manager created the ballot and placed the nominees on the ballot?

Thanks to all of you for your reply's.Donna, I have been on this Board for 2 years, as Secretary. I have good repor with our community. I have spoke with some of our previous Board Directors about this issue on Documents. The Manager has never furnished any past Directors any of our Documents. The Board recieves our Finacial report each month via e-mail. He also furnishes the Members a copy of the Budget each year. Ok, there was a problem in the earlier part of the year with the Landscaping. I requested a copy of that Contract, only to recieve it 3-4 months, later. A long story short, I requested a copy of the Managers Contract, due to a few incidents, he would always delay giving me that one, also.I finally recieved that one approximately, six weeks later, only after he informed me that he was in complete control. He and the manager are quite close, hopefully on a professional basis, as I have no reason to think otherwise. OK, we had our Annual meeting, Tuesday PM. The Manager had the Ballots ready with the nominees on the Ballot. One of the names on the Ballot was elected to the Board, (super nice guy). When it was announced, that he was elected, he commented to all in the room, that he did not know he was on the Ballot, untill he recieved his Ballot to mark his choice for Director. Now please know, there is only me, as Secretary and of course, the President, actively involved with this Board, as (2) have resigned, much earlier in the year, and the other one, her work kept her from participating. OK, we had 2 different Proxies, one being,"Special Meeting", the other being, "Annual Meeting". Ok, I was given these 10-12 Proxies from members, who would be unable to be in attendance.Some of these were sent via e-mail, as Manager said the could do that. He would not allow those, and would not allow the others. You see we did not have anymore "Annual Meeting" Proxies, but had extra, "Special Meeting" Proxies. So he allowed me to keep the 10-12, "Special Meeting" Proxies, but would not allow me to keep the 10-12 "Annual Meeting" Proxies, as I had to cross thru,the word" special", and addthe word " annual" , so then I lost my 10-12 votes for the Board. (my name was also on the Ballot)
The Manager in the only person responsible for all our Records, association funds, in other words, all of the associations business! He has been our associations manager for 10 years. So you see, don't you think the association should be concerned about how the business is handled, etc. So you see, this is the reason the manager, placed these 2 names on the Ballot, (one was placed on the Ballot, due to manager's request, that he be placed on Ballot, and of course this nominee lives out of state). You see, I am the only Board member, who has made a requst for anything in these 10 years. So, you see, when you step on someones toes,so to speak, manager , wants you out! This tells me something is not right!I appologize for the length of this reply.

PS- please know I am not a sore loser, this is not my intention to be placed on the Board, again ,it is just the principle of all this, and I feel the community needs to know, what a sour apple we have as our manager, and it should be brought to someones attention. He certainly is not being professional, and it looks as if he would go to any length to stay in control.
Could someone advise me on how to further handle this?
