We are getting ready to paint our townhouse community of 196 units. We planned on changing the color, the manager said the board can't change the color without a vote of the members. I asked where she got this information from she said since its a "material alteration" the statutes said the board can't change it.

I was speaking with a manager from another company that I know and he said the board can vote on this issue.

Would like to hear your opinion.

One thing is certain, no matter how the Board thinks the color change will enhance or modernize the community, you WILL have people vehemently against the change. Some because they don't like change and some just to be contrary. To minimize this I would call a meeting of the community to discus the change and the reasons for it along with printouts of how the buildings will look after the change. The more homeowners you can get on board with the color change the easier it will be if you decide the community will have to vote on it.

Barbara, I feel your manager is correct. The entire community must have a formal vote to change the color. But then the Board has the right to choose the color. We went through this same thing a few years ago and it turned into a nightmare.

People didn't want just a handful of people (board members) deciding what color "their" condo was going to be. We took it a step further and posted color samples and let people pick what color they liked best. (Informal staw poll.) It was narrowed down to the two favorite colors. We put it to a informal vote of the membership---again--nothing official. It was a tie and ultimately it was in the hands of the Board members to choose.

If you really want to change the current color be ready for some heated arguments. You'll really get a feel for people's "tastes" and being told you have no taste at all. I wish you luck!
