If anyone can provide advice we would be very thankful. We are a group of working professionals and have tried to research this but are limited on time.
Our "development" is very very small. There are 8 units - 4 connected and another 4 connected.
6 of us own our townhouses. The other 2 are owned by the developer. They are in foreclosure after not paying his bills for almost a year.
He has been renting out his 2 units and lying to his tenants about the foreclosure.
I believe he still owns the plot of land to the side where buldings 3 and 4 were going to go. But he has not finished the project because he took his profits and ran basically.
So we are in "limbo" where he is in charge and hired an HOA management company that we cannot get away from.
They charge $180 per month and a year ago started charging us an extra $100 for water/sewer even though our $180 had covered that. It was timed just when he couldn't sell his 4 units in building 2. We had never had that charge before.
The HOA does nothing. They are supposed to mow the lawn but they only come ever couple months and when they do come they do not to ours!
Today my husband asked them why and the workers said they were told only to do the homes in foreclosure! (the ones that the builder guy owned).
Now the builder guy is just a normal person not a real professional builder.
THe HOA management is a real company. BUT they do not reply to calls or emails or voicemails. I gave up on them 4 months ago. I do have recoreds of my various ways to contact them.
THey won't contact any of us because they don't want to have to do any work and they are instructed what to do by the builder guy.
He also did all of the addresses wrong so all of his paperwork for his 2 foreclosed units comes to me and my neighbor with his name and HIS parcel numbers. He put the wrong address on our mailboxes and houses and told us the wrong address. He just has caused so many problems.
HOW do we get away from this HOA Management company that is non responsive and comes up with new fees that were not in our documentation.
We just want to switch companies. One of the homeowners stopped paying because they were not communicating with him either.
I still pay but it's just because I don't know how to get us out of this mess.
$280 / month for nothing is really ridiculous.
And I have been in HOAs before and do not have a problem with them. This one just seems like a total sham.
Specifically what do we do? Because builder never finished the project (buildings 3 and 4) how do we kick him out of being the decision maker?
