Must an informational handout to all homeowners in an Arizona HOA community be approved by the Board of Directors? Several members of the current Board have served on previous Boards and there is evidence of some questionable (can be proven) practices taken place. Two of these members are up for reelection and I feel homeowners, in order to make an informed decision when casting their votes, should be apprised of this information. Several members of other Associations in the area have had similar questions and were advised you may communicate in a non-offensive manner and make sure it is the absolute truth so as not to invite slander suits. Any thoughts on the subject?

IMHO - if these board members were so bad, why have people waited so long to remove them from the board?

I, for one, hate negative campaigning.

Instead, campaign for the people you DO want on the board. If people ask you why you support certain people, you can tell them why. But I would not put anything in writing that could come back at you as an indivudual.

As a member you have a right to communicate with other members of the HOA w/o the BOD requiring your communication to be approved by them. However, make certain you do not make any accusations against a sitting board member that you cannot back up with proof. BTW, what are the "questionable practices" to which you allude. Oftentime these "questionable practices" are only perceived to be questionable. In many instances members do not fully understand the gov docs and/or state law and think the BOD is doing something improper when, in fact,they are not. I'm not saying this applies to you; just saying that it does happen all too often.
