I have recieved so many letters about two matters i am being asked to take care of.One, being a very small lawn problem that takes time to see improvement.Second,being behind one quarter HOA fee for the first time in. three years.I have explained to them several times,i realize i am behind but without a job right now i don't have the money to pay it,as soon as do i will send it to them.The letters continue to come that they are going to take legal action another letter saying they are charging $25.00 a day untill i resolve this.Would you say they are insane along with harassing me?I think so and what do i need to do about this?

YOu need to speak to them personally. It's not harassment if you owe money... it called a collection policy.

I agree that a simple phone call could probably clear this matter up pretty quickly.
As for the lawn issue, just fix it. Tell them the steps you have made towards the matter and how long you feel it will take for it to be completed.
The dues must be treated as any other bill. Would you expect your mortgage or credit card bill to be okay with you paying late? So you might want to cut them a break on this one, they are doing what they bound to do. However, because your HOA is run by neighbors they are more than likely going to help you out. We have had a couple instances where homeowners have lost their job. We did everything we can to work with them. For example, waving the late fees, setting up payment plans, and waiting until tax return to get our money.

We can tell you what we think your board should do but that doesn't mean that's what they will do. As long as what they are doing is not in violation of your gov docs or state law, then they aren't doing anything wrong. Some boards are easy to get along with, others aren't!!

The way the system should work is that once you have met with the board and explained your situation the board should let you know what they will accept regarding the nonpayment of assessments and the landscaping problem. Many boards will waive late fees if you are having financial difficulties and are unable to pay your assessments. The best thing to do is to agree on a payment plan so that you will be paying something from month to month. As for the landscaping problem, if you have informed them that you've taken care of it but it will be awhile b/4 the results are noticeable they should not continue to send violation notices with the threat of fines of $25/day. Also, many boards will waive the fines/penalties if you have convinced them that the problem has been cured or will be w/i a certain period of time. What exactly did they say when you met with them? Perhaps it's time for another meeting. BTW, what is the "very small lawn problem"?
