Is there a regulation that all HOAs must have an active ACC? If considering hiring a management company, does that mean the HOA can dissolve the ACC? Some people hope that is so because of ill feelings about past violations handled by past ACC members and past Boards.

No, hiring a mgmt co does not mean the ACC is automatically dissolved. My assn has a property manager who resp for noticing CCR violations; however we still have an ACC committee. The committee is only resp for handling ACC requests for changes to their property. By having the prop mgr handle the noticing of violations it does take the burden off the back of the ACC members and the BOD because if a member gets angry over receiving a violation notice their anger is usually directed at the person who sent the violation notice which is the PM. I find this to be more of a problem for the BOD and ACC members in a small community rather than a large community. People can't seem to understand that if you are a board member or ACC member you have a job to do and if that means sending a friend a violation notice, so be it. It's nothing personal, but some people just can't seem to separate the two and it can make it very difficult for those who want to serve their community and still remain friends with everyone.

As far as having an active ACC, that would be determined by what your CCRs say. However, I'm sure your CCRs talk about enforcement and also about requests for architectural changes which are two resp's of an ACC, or the BOD in absence of an ACC. If the CCR restrictions are not enforced and there is no means to obtain approval for architectural changes your community could evolve into a place where you would not want to live and perhaps no one would want to buy property. Just think of all the CCR restrictions and what the community might look like if everyone violated them and also try to imagine what the community might look like if everyone could do whatever they wanted with their property.
