Our HOA (Fl) is having no election this year all 7 are staying on. Even though our docs state,officers are elected for 2 years , 3 members for 1 year. The Bod say they don't care what the docs say. Anyone know, how to contact the state? How to do it? This is deffinately not right..

WHEN are elections supposed to take place?
Your board needs to give a reason it is going against its own governing documents.

Everything is in your docs but Fla Statute 720.306(9)states that a homeowner may nomiate himself or herself from the floor where elections are being held. Fla Statute 617 Voting By members gives the homeowner the right to send in a proxy. Get the homeowners together(call a special meeting, the expense of the meeting is paid for by the Association)and go after the board. Seek help from an HOA Attorney.

Laverne, just because all of the Board members want to remain on the Board has no basis for not having an election. Those Board members who's term is expiring have the right to be candidates as well as any other members who wish to be candidates. All need to be nominated, even if it is self nomination. And an elect must be held. If the Board knows the Bylaws and refuses to comply then the members need to consider removing any Board member who knowingly violates the Bylaws.
