We have tried contacting hime by certified mail, phone, letters, no response. He does not live in the condo, but for the window has a huge hole in it. What is the HOA liablity if mold, dead animals exist? Also can we "make" him repair/replace window?

Look for a provision in your CCRs which allows the assn to make the repair and bill the property owner. If you have such a provision make certain you inform the member of your intent b/4 having the work performed. Do you have his current address and are you sending him letters to the condo address?

In our declaration it states that people must keep their house in repair. If you have the same thing I am sure your lawyer could get him to do it.

I would get a lawyer involved as well - make sure your docs state that you can charge pre-litigation fees to the homeowner or be prepared to go all the way to a judgement to get your money paid to the lawyer assigned to the homeowner.
