I purchased a PUD/Townhouse in June and have yet to move in because it was a shortsale and needed work.

I read the CC&Rs and have been doing my renovations accordingly.

Two board members who live there have been hassling me because I changed my front door and door leading into the garage. I replaced the old rusty beat up doors with new white doors with windows. The CC&Rs state the upkeep of the front door is up to the owner and only changes that are VISIBLE from the street need approval. My front door cannot be seen anywhere from the street, it can only be seen when you actually walk on my property. I havent received letters yet. Apparently they have been sending them to the previous owners despite me being on title since June. Also, two other homes in the development have different front doors and have had them for years BUT they arent bothering them. I am the newest and one of the youngest owners. I dont want to create a problem but telling them they are discriminating against me due to age is a thought that has crossed my mind.

I also want to move my side fence my neighbor and I share forward about 10 feet. My neighbor is ok with it. Right now we have side windows that look directly into each other and side yard space that is ours but we cannot use. My Dad mentioned maybe we should put solid front doors back on because he feels if we battle for the front doors we wont get approval for the fence....even though I own the land. Not to mention, there is no consistency in fence placement when looking at the other units. I'd rather have more side yard then a front door with a window but its the principle of the matter that bothers me. I am improving my house and which helps the value of the others. They are trying to keep things 20+ year old. The CC&Rs state that changes that are consistent with high end developments in the area are ok.

Being a PUD I own the land. The HOA is in charge of the greenbelt/exterior maintenance of the place.

Hi Kevin: Welcome to the sometimes headaches of living in an HOA.

Be sure to check your local government ordinances regarding the fence, as the city will also have it's own requirements.

I would suggest next time they say something, smile and ask them to please let you know what CCR you have violated and how it was violated. When they cannot give you an answer sometimes they will cease. You will get a few individuals who have nothing better to do, so guess what they do with their time. Getting you upset, will just make it more fun for them.

As long as you carefully follow the rules ... then it is your home.

janet gives solid advice here. Kindly ask them to show you the regulations you are violating, so you can learn. there is a chance you missed something, and are in violation, in which case, you learn something and can do it right. Odds are, like Janet said, they will point out something incorrect, you can correct them, and be done with them.

There is probably something in the CC&R's that require permission prior to making exterior changes. You doors would be exterior changes (doesn't matter if they can be seen or not). Did you seek and receive permission for those changes?

Kevin's OP stated that the CCRs state ONLY changes visible from the street need approval and his door can't be seen anywhere from the street.

I know you are new to HOAs and want to get off on the right foot, so. . .

1) Even though you may think you don't need approval for a particular project, it's always wise to ask if prior approval is required.

2) Whether the HOA or the h/o is required to maintain a certain element of their lot/unit has no bearing on whether prior approval to change or improve that element is required.

3) The fact that other homes in your community have done what your want to do has no bearing on whether your improvement is in violation or not. In fact, it's wise to not even think about what other members of the HOA have done with their property, your only concern should be your property.

Regarding your side fence: I suggest you submit a request to move your fence. State the privacy issues as you have stated them here and you may mention that your neighbor has no objection to the change. But, please do not make mention of the lack of consistency in fence placement throughout the community. It's best not to make any derogatory comments, especially when you are asking for something.

I know it's hard to understand why the HOA should have the authority to tell you what you can and cannot do with property that you own, but that is the nature of HOAs. If you can live with this and not let it bother you then you won't have any problems adapting to living in an HOA.
