DRAFT PARKING RULES
1-Each resident is permitted a maximum of 2 motor vehicles.
2- Each motor vehicle belonging to residents must have a resident parking permit displayed in the front window over the vehicle VIN #
3- Resident will be given 1 visitor permit (reusable) resident is responsible for making sure their visitor has the permit displayed in the front dashboard and that they are parked in visitor parking stalls(any visitor parked in “Resident Only Pool Parking” stalls will be subject to immediate towing at the owner/operator’s expense). Any visitor parking overnight three times in a 5 day period will be considered a resident, and thus be towed on the fourth time for illegal parking. If your visitor’s are staying for more than three days in a 5 day period, or you are having more than 1 visitor you must call the management company to get a special visitor permit.
4- Resident will receive 1 resident temporary visitor parking permit (reusable). The resident will be permitted to park in visitor parking areas (not “Resident Only Pool Parking” stalls) for the following reasons:
• resident is cleaning garage, driveway or exterior of unit( permit will become void and you will be subject to towing at the owner/operator’s expense when no one is seen cleaning garage, driveway or exterior of unit, garage door must be open if using this permit)
• landscapers are on the property and you don’t want to grass or dirt to get on your vehicle ( permit will become void and you will be subject to towing at the owner/operator’s expense when landscapers have left the property)
• resident visiting another resident and can’t park in the driveway of the unit they are visiting (if driveway is vacant of unit you are visiting you will be in violation of this permit ( permit is invalid for overnight parking) If you have a unique situation that will cause you to park more than twice a week in visitor parking (example: a family member or friend lives in Edgewater and you can’t park in their driveway) you must contact the manager for Board approval and a special permit)
Pool Parking
• Areas designated as “Resident Only Pool Parking” are reserved for residents using the pool only. If the vehicle doesn’t have the resident parking permit displayed as instructed you will be subject to towing at the owner/operator’s expense.
• If the resident is found not to be using the pool the vehicle will be subject to immediate towing at the owner’s/operator’s expense
• Visitors are not permitted to park in “Resident Only Pool Parking” stalls and will be towed at the owner/operator’s expense.
• When the pool is closed any motor vehicle parked in the “Resident Only Pool Parking” stalls will be subject to immediate towing at the owner’s/operator’s expense.

5- Any vehicle in Edgewater without a resident permit or visitor’s permit will be towed. The towing company will monitor all vehicles parked in Edgewater for any violations, and tow the vehicle for any violation of Edgewater rules. Towing will be at the owner’s/operator’s expense.

6- New Residents must contact the manager and get a 10 day new resident permit; permit will be void on the 11th day. The resident will have 10 days to register their 2 motor vehicles with the manager and receive the normal resident permits.

7- Anyone needing to replace a resident permit, visitor permit, or temporary resident in visitor parking permit will be charged a fee.

8- Owners are responsible for making sure their visitors display the proper parking permit and follow all Edgewater parking rules.

9- Landlords are responsible for making sure their tenants display the proper parking permit and follow all Edgewater parking rules.

10- Tenants are responsible for making sure their visitors display the proper parking permit and follow all Edgewater parking rules.

Be aware that towing of vehicles is severely restricted in Florida. You need to check Florida Statute 715.07 for specifics.

Question: If I have 4 residents in my home does that mean I can have 8 vehicles?

Suggest changing the word resident to the word lot or property

Sounds like the Association is limiting the number of vehicles that a member may own vs the number of vehicles that a member may have parked on the property. Suggest rewording to: each lot will be issued 2 resident parking permits and 1 visitor parking permit.

Two issues:
1 - Use of the word resident again and the structure of the sentence implies that a resident who owns 5 vehicles must have 5 permits. I expect that your intent is to limit each lot to have only 2 parking permits, therefore you should reword it to indicate that. Perhaps: Each vehicle parked on the common areas parking spaces must display a parking permit or be subject to towing at the owners expense.

2 - Based on military stickers, I believe that it may be illegal to cover a vehicles vin number so it can not be seen by law enforcement officials. You should check with your local police and military bases to see how your permit location might impact them. Then specify in more details where the sticker or permit must be displayed.

The use of the word resident again. A resident is anyone who lives there. Per this paragraph, if I have 5 people that live in my home (each being a resident) I then get 5 visitor passes (1 per resident).

I could pick this apart more but you get the idea. I would suggest that you outline the policy with fewer words and in a better format. Suggest something like:

Parking Rules of xyz Association

I Definations:
lot = house
member = owner of the house
property - xyz Association
resident = person who resides at a lot on the property

Most of these can be taken from your governing documents.

II Permits:
Section 1 Resident Permits
(a) Each lot shall receive 2 resident permits
(b) A resident permit must be properly displayed on all vehicles that are parked in spaces marked for residents only

Section 2 Visitor Permits
(a) Each lost shall receive 1 visitor permit
(b) A visitor permit must be properly displayed on all vehicles that are parked in spaces marked as visitors
(c) Visitors parking in resident only spaces may be towed at the owners expense

Section 3 Special Visitor Permits
(a) Special Visitor Permits may only be issued by abc
(b) requests for special visitor permits must be in writing and the license plate number will be required.

III Violations

You get the idea.

As was previously recommended, you should check your county and city laws and ordinances to see what requirements are needed to enforce towing.
