Can the secreatary emoloyed by our HOA, do all the financial things? Like write out the checks, do the budget, etc? We now have a Board member who is quite capable of doing this but is keeping her in the dark. This is a Fl HOA and can not find anything in the statues as to if this illeagal? Bod does sign the checks, but other wise office does all the rest...

Are you a member of the board or just a concerned HOA member? If the secretary is employed by the HOA then I would think she is only doing what she is being told to do. Since you say you "now" have a board member who is capable of performing these financial duties I'm of the impression it was not always that way and perhaps that is why the employee was instructed to perform these duties. If that should be changed then the board must instruct her accordingly; otherwise she may just be doing what she has been instructed to do. I doubt you will find anything in the state statutes outlining the duties of board members or individuals employed by the HOA. Regardless it doesn't appear that anything illegal is taking place with this arrangement.

Would you tell us about the size of your HOA, and is it managed by a CAM (Community Association Manager)?
Is this Secretary directed by a CAM, or perhaps this person is a CAM and you are calling her a Secretary.

It is not necessary to have a member of the Board do the actual office work and paperwork of a routine nature for the property as long as the Board reviews the actions of the secretary as part of their role.

Board members do not volunteer their time to do office work, I would guess that is why your property hired a secretary in the first place.

The Board can also hire others to perform work on behalf of the property.

Illegal??????? As others have suggested I would be of the opinion there is no legal matter involved in this at all nor would there be any section of Floida law that might prohibit this action.

Thanks for all the replys. No, she does not have a CAM license.

No, I am not a BOD. But was for 4 years , 3 as President.After looking into it further I see nothing illeagal about what she is doing
