7 people in park including myself came in under rule no boats, campers, trailers are allowed on site except with permission by president.

Our camper is not stored and never has been, only permission by Pres to load and unload for camping trips. The other members took the approach of could care less what the board says. President told my husband, if they can hide it on their property what's the harm.

Is this breaking their own rules? selective enforcement?

you open with "park" - if you're in a trailor park, then you're trailor/RV has no place to be other than right out there for all to see - personally I feel that whether you're in a trailor park or townhouse condo development, boats and rv's shouldn't be stored outside in full view - the small Winebago Rialto however could conceivably fit in a garage and be concealed - that would naturally be Ok - so if the rule is nothing can be left outside then the President's quip that "if it can be concealed ( & I don't mean under a tarp outside) then that's Ok" is in the spirit of the rule.

but it would be helpful if you could better describe your community type and what the rule is precisely.

Unless the bylaws give express permission for the president to OK what vehicles are parked where, I'd ignore it.

Make them show you WRITTEN rules. Members who pay the same dues cannot have different rights/rules UNLESS it is in documents.

it is a mobile home park. Rule made in 2005, states, no rv, boats, trailers are allowed on site. most of them are behind or along side sheds covered under tarps. All of them came in under same signed lease agreement as us.
rv's are allowed however by immediate family member for 2 weeks parked in your driveway. residents are not

now that I read your post again I'd like to know what " hide on property " means - for example, if he means a 30' boat is Ok if it has a tarp over it in back of the house then yes I agree with you he's bending the rules - however, if someone can garage - and I don't mean an outdoor tent - a 30 footer then more power to him.

thank you for you reply. we have not kept our RV on our site, becuase we adhered to the rule in which we were told and signed in our lease agreement.
However, since 2008 we have came in under the permission by the president for 2 weeks before and 1 week after our trips.

The utility trailers and boat owners, are in the backyard of their property since they came in and were never told to remove it. the board knows that they went against the rules and now they don't know how to enforce it. They are only enforcing a two day rule on us and we don't even store it there. We have now contacting an attorney who agreed with the the second reply

OK now I get the picture - you're absolutely correct and looks like you're following the rules - others aren't - he's bending the rules - or as you said it's selective enforcement.

but now the tougher issue is - how do you get the President to enforce those rules - this is where it gets sticky - maybe others on this forum have some good ideas based on experience.

I'm VP on our Board and I can't even get the Treasurer to write vendor checks timely - we're all volunteers - you do the best you can - as in life there's always unfairness but in your case I'd continue going with that rule - IMHO it makes sense .

Half of the board members didn't even know, there were boats, utility trailers on other members sites????? When I asked this question at the meeting on what they were going to do about it, my reply was "don't know" I guess we have to ask the HOA's attorney, we are all volunteers here and don't know all the rules.

So again, why are we being singled out for NOT ABUSING THE RULES and not the others that came in under the same agreement? Reason, 2 board members said that they just don't like campers. Well I said, it's not even being stored on our side. We only go camping in July and October. According to Robert's Rules
everyone should be treated equal, and everyone pays the same amount of dues.

Kathie,

Mobile home parks are much different than condos and planned communities. Have you checked to see if CT has laws for mobile home parks? I would check that out to see what your rights are as a member of a mobile home park HOA.

out town has no restrictions on rv's. they say it's the Park that makes it's own rules. Park says they are a private entity and can make any rules they want

we have friends that have a mobile home in Maine - the owner of the park makes the rules - no HOA - but it sounds like you must have a park owner and also an HOA - is the park owner on the HOA Board ? and who trumps who - I can understand the owner wanting a Board to help him set acceptable standards of operation and it also releases him from any perceived bias - but regardless once the rules are in place the Board & owner need to follow them .

this is a resident owned park. the hoa makes the rules and said they are a private entity, can make any rules they want and change any time they want

Well that's great, but isn't a rule a rule?? and doesn't it apply for everyone?
One board member told us that if our camper comes in, they will tow it

my suggestion would be to get a lawyer familiar with - or willing to research - the legal positions here - good luck !!

we are and it should be a no brainer. Enforce the rules for those who brought the boats and trailers in, and leave the people alone who abide by the rules.

The rule is clear to me. No RV's stored on site, means just that. Since I use to be the former treasurer, I didn't see where these people paid more dues than us or signed a different lease agreement.

The Board claims that we go by Robert's Rules. Aren't we suppose to go about things in a democratic way and equal rights for everyone??

here is an update, HOA decided to make all boats legal now, all of them came in after the rule in 2005. They all moved in 2006 and 2007
