We have a new neighborhood. There was a bill of assurance filed with the county clerks office. We are wanting to start a POA or HOA. We had a neighborhood meeting yesterday with 45 of the 55 families showing up and all in favor of the poa. What is our next step? Thanks in advance for your help and suggestions

Doug, do you have a Declaration of CC&Rs on file with the County? If not, you need to draft a Declaration, get 100% of all owners to sign notorized statements agreeing with the Declaration, and file the Declaration with the notorized statements with the County Clerk. After that you can draft and approve By-laws, elect officers, and if desired file Articles of Incorporation with the Secretary of State.

I’m not 100% sure about this, we are in the process of starting our journey to becoming a POA, however I believe you must have a certain percentage sign saying they agree to the change.As Roger has stated above.
I’m sure someone that frequently visit’s this discussion forum can be of much more help.

I’ll be leaning with every response you get.

Rodger, are you saying the HOA do not have to file Artoration. I always thought you had to have all three(3).What is the advantage of filing or not filing?...Thanks
