We are a small 8 Lot community and a recent Lot owner requested permission to install a fence. The vote was a tie. Board of Directors are also the officers of the HOA. How do we determine the out come of the vote since there are 4 against and 4 in favor. Each lot owner(s) is entitled to 1 vote. There is no wording in our covenants/by-laws covering a tie vote.

A tie vote means the action died. Since this is a request for an ARC action it should be brought before the members for another vote. However, why is this being brought before the members for a vote instead of the ARC committee or the BOD? I know this is a very small HOA but are your certain your CCRs require the members to vote on this action?
