Also, check your state HOA statutes because in CO if a rule is not followed and nothing is done within one year to correct the violation the rule then becomes null and no longer a violation.

HAVE A ISSUE , HOUSE BUILT 3 YEARS AGO ONLY 1000 SQ FEET

COVENANTS SAY IT NEEDED TO BE 1500 SQ FEET

NOTHINGS WAS DONE TO PREVENT THE HOUSE TO BE BUILT (IN VIOLATION OF COVENANTS)

Are you certain the CCRs say all homes must be exactly 1,500 sq ft or do they say they cannot be larger than 1,500 sq ft?

On the other hand, do you think this person should be made to tear down their 1,000 sq ft home and build one that is 1,500 sq ft? What's done is done; just make certain it doesn't happen again.

SEVERAL HOMEOWNERS THINK DEVELOPER GAVE APPROVAL TO HOMEOWNER WHO BUILT 1000 SQ FOOT HOUSE THAT'S WHY HE BOUGHT THE LOT

THE COVENANTS SAYS HOUSE NEEDS TO BE AT LEAST 1500 SQ FEET MINIMUM

IF IT WAS TO BE LEGALLY ALLOWED THERE NEEDED TO BE A AMENDMENT TO THE COVENANT

THERE IS NONE

DOES THIS GIVE ME THE RIGHT TO VIOLATE THE COVENANT AS WELL

DID THE HOMEOWNER SET A PRECEDENT HE HAS NEVER BEEN GIVEN NOTICE THAT HE IS IN VIOLATION

ACTUALLY THE HOMEOWNER IS A WONDERFUL PERSON WHO BUILT 4 YEARS AGO

SO I WANT TO BUILD A 1000 SQ FOOT HOUSE AS WELL

Jack - you want to violate the CCRs of your HOA because someone did it before.

How active your HOA is will determine whether or not you can get away with it.

PS Can I put a trailer on the lot next to yours? Seems like no one cares and anyone can do anything they want.
