Our board president not telling the rest of the board excused legal fees to one unit that owed almost $1000. he said he's the President and can do whatever,
we feel differently because that money is coming now out of all the other owners
pockets, can we as a board disclose this to the other owners and maybe finally
get this president voted out?

Why not simply remove him from his position of president. As far as telling the owners individually, I would recommend against it however there is nothing to stop a Board member at the next meeting from making a motion to reinstate them.

can't get the board to do anything, some of them - like him - are behind in their association fees. if we could get an accurate financial statement i think people would see the misconduct going on. i have been unable to find what branch of the irs to report them to so an outside audit can be done and they can't cover their tracks.

The unit owed $1,000? Was the actual arrearage paid up?

While the president was wrong to to do this on his own, with the economy the way it is, waiving certain penalties may be in the best interest of the HOA.

If the other board members are outraged at his actions then they should remove him from the position of Pres. Take a good look at your bylaws to see if there is a provision to remove him from the board for being more than 30 days delinquent. Many HOA bylaws have this provision. Have past due notices been sent to him? If not, why not?

BTW, while it is often acceptable to waive late fees, I don't think it prudent to waive attorney fees leaving the HOA totally liable for payment thereof. The board should write a letter to that h/o informing them that the Pres did not have the authority to waive the attorney fees and they are still due and payable. This errant Pres needs to be put in his place -- immediately!!
