We're a small HOA in NC. Property owner wants to 'appoint' some one to represent them on all HOA matters.
Person has a proxy for meeting, however, there is thought this person may be nominated to hold office.
Our meeting is next week & I want to be clear before it comes up. Thanks, HOA Secretary

do your docs state that in order to be on the board that the person must be the owner of record for the property within the sub?

People can be appointed as a proxy for meetings by another, in that capacity they would be able to vote on items presented to the general membership for a vote just like the homeowner.

He would only be voting for owners that are appointing him to do so. Your By-laws should cover who can be a proxy.

represent him throughout the year. Also wants to nominate this person for a board position.
Person no longer owns property in community nor does he live there. Does that make sense?

If your bylaws state only members may hold a board position then this proxy-holder cannot serve. Some assn bylaws allow nonmembers to serve on the board. It all depends upon what your bylaws say. Holding a proxy only allows the proxy holder to vote and to represent, and perhaps speak for, the member at meetings and that is the extent of the proxy-holder's rights.
